Confusing time limit

Posted date : Jan 13, 2023

It is very confusing how to fill out the FORM 8840. Say I arrive in the U.S. on November 15 of a given year and stay until April 28 of the following year. My question is, do I count only from November 15 to December 31 on one Form 8840 and then “save” the rest (January 1 to April 28) for the next year

I-94 Form − problem every time at land border − what can be done?

Posted date : Jul 23, 2021

Is the CSA even aware of the Form I-94, as I never see any articles or questions about it? This form states how long a Canadian can spend in the U.S. and, every time I cross the border, people set it for only 90 days! It is so frustrating! Last time I asked a border security person to make it April 1, and he said that he had “no clue what I was talking about”!?

Cruise time reporting to 8840

Posted date : May 13, 2019

As a Canadian snowbird, I fill out an 8840 annually. On occasion, we have taken a cruise which originates in the U.S. How is this time included in my Form 8840? Of particular concern is a recent Alaska cruise which originated and ended in Seattle, WA, but could be in the Caribbean or to Hawaii. […]

Time out of country

Posted date : Dec 15, 2017

Confused; friends go out of country for just under six months each and every year. How is this possible with calculating back two years prior. Is there something I am not understanding, as a lot of people I know do five to six months every year. Herman B. Port Colborne, ON Response: Ed.: Your friends […]

Do you have an address if you live full-time in an RV?

Posted date : Nov 13, 2017

Dear Bird Talk, The vast majority of snowbirds are without a Canadian home address for the simple fact that they have sold their homes and are living full time in their RVs. Ever try to get into the U.S. with a title of homeless? Not only border crossing; try getting a licence for anything. My […]

Questions about time permitted in the U.S.

Dear Bird Talk, I read an article online that was published by the Star which stated some information of which I was unaware and am wondering if you could clarify. We are aware that we can stay for up to 182 days out of a year. What I was unaware of is it also states […]

Clarifying amount of time allowed in the U.S.

Posted date : Nov 13, 2017

Dear Bird Talk, We understand that there is a limit of 182 days for Ontario residents to be in the states per year. Does the year run from January to December (calendar year), or how do they estimate your stay in the states? Beth Duffield Point Edward, ON Response: Ed.: For clarity, a Canadian is […]

Going home for a week at Christmas and return to the U.S. – Will this be counted as time in U.S

Posted date : Nov 13, 2017

Dear bird talk, I understand that if I go to the U.S. in October and say that I am going for six months and then go home for Christmas for a week, that time is considered to be spent in the U.S. What if I go in October and tell them that I am going […]

Medical extensions for illness when it’s time to go home

Posted date : Nov 13, 2017

Dear Bird Talk, With the new Canada/U.S. border-crossing procedures, the issue of days spent in the U.S. is becoming more and more troublesome for many of us. It recently occurred to me that if you have used up most of your 182 days’ entitlement and you are still in the U.S., and a medical problem […]

Subtracting Time From Six Months

Posted date : Nov 13, 2017

I sit in dismay, having read your response re: subtracting time from six months. You say that a fewer-than-30-day return to Canada cannot be subtracted when calculating total days allowed in the U.S. We have spent three to six months every year since 1994, always coming home for Xmas. Our time was not always the […]
